Indian River County – If Florida voters approve Amendment 2 on the Nov. 8 ballot – changing the state constitution to allow medical marijuana – the County Commission wants to restrict where the dispensaries or treatment centers would be allowed.

The county is preparing changes to land development rules that would restrict the centers to only a few locations in unincorporated Indian River County.

They would be adjacent to the railroad right-of-way north of 12th Street and two other parcels east of Old Dixie Highway near Ninth Place, both in Vero Beach.

“If Amendment 2 passes, we want to limit the locations in our code,” Community Development Director Stan Boling said. “The board’s intent is to have local regulations in place before Amendment 2 is passed by the voters and the state promulgates rules.”

County Attorney Dylan Reingold also has prepared an amendment to the county’s pain-management clinic law to address medical marijuana dispensaries. The amendment addresses the manufacture, handling or distribution of marijuana, including low-THC cannabis, as well as other criteria such as on-site consumption of marijuana, loitering, prohibiting drive-through service and limiting operation of facilities to daylight hours.

A public hearing and vote is set for Tuesday’s County Commission meeting. If commissioners adopt the ordinance in October and Amendment 2 fails in November, the ordinance could be repealed.
